
Four defendants in the act of committing acts of homosexual acts have been released in court after the Judge Magistrate's Court Mwanza dismissed the grounds for restricting their guarantees to the Republic.
The decision was issued by Chief Justice Wife, Wilbert Chuma today on December 15, after agreeing with the argument of defense lawyers, Mashaka Tuguta, Ogastini Kulwa and Jebra Kambole that the arguments submitted by the prosecution are weak in the eyes of the law.
The defendants in the case number 548/2017 are Miley Suleiman and Janeth Swazi who are supposed to disagree with each other's ring of romance despite both being women.
Others are Aneth Mkuki who is required to perform the two festivals with Richard Fabian charged with an error on the Internet by distributing the event video to social networks.
In his decision, the Citizen Magistrate said the Court could not work on information and objections and rumors that the accused could be harassed by a community that was violated by the act they were charged with.
"It is a court decision that collateral is the right of the prosecutors and the prosecutors have failed to submit basic grounds for why some of the more conscientious objectors are being discriminated against by the community without explaining what they are going to do with the person who will harm them," said the Citizen's decision in his decision
The defendants have been released on collateral after completing each other's terms with one identity guarantor and identity letter from the recognized legal authority and signing a deposit of Sh6 million. The request was postponed until January 8, at the expense.
